What Is Required For A Binding Contract?

A binding contract is a written agreement between two individuals — or entities — that can be enforced by law.

To determine if you have a binding contract, it must contain these three basic elements:

  • an offer
  • an acceptance, and
  • consideration (payment or a promise).
